Terms & Conditions

1. Interpretation

“Terms” means these terms and conditions of use. “Site” means the Education Incorporated website (educationincorporated.co.za) and any linked pages, social media channels, or online shop we operate. “We”, “us” and “our” refer to Education Incorporated (Education Boutique School (Pty) Ltd). “You” refers to the user or visitor of the Site.

 

2. About Education Incorporated

Education Incorporated is an independent school operating from a single campus at 40 Kingfisher Dr, Fourways, Sandton, 2055. The school is registered with the Gauteng Department of Education (GDE), and the Independent Examinations Board (IEB) sets and marks its Matric qualification, which Umalusi accredits. The school is a member of the Independent Schools Association of Southern Africa (ISASA) and is evaluated regularly by the Office of Independent Schools Evaluations Southern Africa (OISESA).

 

3. Use of This Website

This Site is intended for prospective and current parents/guardians, students, and staff of Education Incorporated. You may not use the Site for any unlawful purpose, to transmit harmful code, or to attempt unauthorised access to any part of the Site or its underlying systems. The Site is supplied “as is” and has not been compiled to meet your individual requirements; it is your responsibility to satisfy yourself that it meets your needs before.

 

4. Service Availability

We aim to keep the Site available at all times, but we may suspend access without notice for maintenance, system failure, or reasons beyond our control. We accept no liability if the Site is unavailable for any period.

 

5. Intellectual Property

All content on this Site — including the Education Incorporated name, crest, house names and imagery, photography, and written content — is owned by or licensed to us and is protected under applicable intellectual property law. You are granted a non-revocable licence to access and use the Site, and to download or print material from it, solely for personal, non-commercial, lawful purposes, provided all copyright notices remain unchanged. No other reproduction, distribution, or commercial use is permitted without our prior written consent.

 

6. Admissions Enquiries

Submitting an enquiry through this Site is an invitation to do business, not a binding offer or a guarantee of a place at the school; no agreement is concluded until we acknowledge and accept your enquiry or application directly. All enquiries team. Our four-step admissions process (Enquire → Meet the Deputy Head → Trial Week → Acceptance Letter) applies to Grades 4–11 at any time of year; Matric (Grade 12) admissions follow a stricter cutoff, as described on our Fees page. The Trial Week fee (currently R1,500) is non-refundable if you choose not to enrol, but is deducted from your first month’s fees if enrolment proceeds.

 

7. Fees & Payment

Full fee terms, payment schedules, and available discounts are published on our Fees page and are subject to change. When you pay online through this Site, PayFast, a PCI-DSS-compliant third-party payment gateway, processes payments; Education Incorporated does not see or store your card details. You are responsible for confirming current fees and payment terms with our Admissions or Finance office before making a payment.

 

8. Online Shop & Purchases

The following applies to any purchase made through our online shop:

  • Placing an order is an offer to purchase, subject to these Terms and the prices/terms current when you submit it; a contract forms only once we send you an Order Confirmation.
  • Until we accept an order, we reserve the right to decline or cancel it (including where fraud is suspected or a product is unexpectedly unavailable) – in which case we will refund any payment already made in full, using the method you originally paid with.
  • Displayed prices are in South African Rand and include VAT. Orders are collected from the school office; we do not currently offer courier delivery.
  • If we discover a price error before we accept your order, we will contact you to confirm the correct price before proceeding.
  • All payments are processed through PayFast, a PCI-DSS-compliant payment gateway; Education Incorporated does not see or store your card details.
  • We retain a record of your order in our systems for 12 months from the date of sale; after that, you are responsible for keeping your own record.
  • Purchases are further subject to our separate Refund and Returns Policy. Product photography is provided for reference; minor variations in colour or finish may occur.
  • If you create an account to shop with us, you are responsible for keeping your login details confidential and for all activity under your account, and must notify us immediately of any unauthorised use.

These terms are subject to the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”); any term that conflicts with ECTA’s compulsory provisions is modified only to the extent needed to comply.

 

9. Privacy & Data Protection

Personal information submitted through this Site (including through our enquiry form) is collected and used solely to respond to your enquiry, process an application, or fulfil a purchase, and is handled in accordance with the Protection of Personal Information Act (POPIA). Our PAIA Manual, which describes how we handle information requests under the Promotion of Access to Information Act, is available for download in the site footer. We do not sell or share your personal information with third parties for marketing purposes.

 

10. Links To and From This Site

This Site links to third-party sites (including IEB, ISASA, Umalusi, GDE, OISESA, our social media channels, and our payment gateway) for your convenience only; we have not reviewed these sites and are not responsible for their content, accuracy, or availability. You may not link to this Site from a third-party site without our prior written consent, and any permitted link may not misrepresent your relationship with us, alter our crest or branding, or imply an endorsement we have not given.

 

11. Disclaimer, Liability & Indemnity

This Site and its content are provided “as is.” While we make reasonable efforts to keep information (including fees, dates, and policies) accurate and current, we do not warrant that the Site will be error-free or uninterrupted. Subject to sections 43(5) and 43(6) of ECTA, Education Incorporated, its staff, and its Board will not be liable for any direct, indirect, or consequential loss or damage of any kind (including loss arising from viruses or other harmful code) arising from your use of, or inability to use, this Site or any linked third-party site, to the fullest extent permitted by law. You agree to indemnify Education Incorporated against any claim brought by a third party arising from your breach of these Terms or any applicable law.

 

12. Governing Law

These Terms are governed by the laws of the Republic of South Africa, and any dispute arising from your use of this Site shall be subject to the jurisdiction of the South African courts.

 

13. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date above reflects the most recent revision. Continued use of the Site after we publish changes constitutes acceptance of the revised Terms.
